    Deplorable policy by Nintendo. It sucks that governments have to step in & protect consumers from things like this, but the market is broken & people keep buying these products, so Nintendo won’t change unless they’re forced to.

    Revoke your access to their online services? Absolutely yes.

    Render the device unusable? Absolutely no.

    There’s not much opinion to be had- Nintendo has no right to brick something that you bought and own. ToS isn’t law, they don’t get to take back something because they don’t like how you use it.

    I don’t even do this kinda thing often. Last thing I did it to was my PSP after Sony was well done with the platform n’ it was mostly to play games without my disc for better battery life and loading speed.

    That’s been a staple of consoles since at the PS3/360 days. Are they going to sue Sony and Microsoft too? And Nintendo isn’t just going to do it for the lulz. If you have a hacked system or pirated game then you’re barred from their online services.

    No manufacturer should be able to permanently brick a console, especially with many reports stating that Nintendo has no way to reverse it once done. That sets a really bad precedent if no one were to contest this in court. Hopefully Brazil wins

  18. My opinion is thst way to many people know thst every console manufacturer can do this but everyone only shits on Nintendo for whatever reason. This also could be done with the Switch 1 already. Had it happened? No.

    Either don’t shit on anyone or on all of them. Shitting just on one is double standards.

    For the problem itself: yes, the manufacturers shouldn’t have the power to brick your console. Even if they never did it before, they shouldn’t be able to in the first place.

    Don’t steal games or hack into their system. If you don’t want to follow their rules then don’t buy their system and sign into their online service. It’s not that hard.

    Y’all seemuneducated on this topic. You want an incentive for your devices to be stolen and resold? Do they not sell Samsung or Apple phones in Brazil? An activation lock is getting to be pretty standard.

    On the whole, deffering the market for theft is probably more important than some vague concern Nintendo will suddenly turn against their customers.

    My opinion? People are taking it out of contrast. What will happen with your digital games when the PS4 store shuts down? Or when the PS6 doesn’t give compatibility to ps4 games.
    Nintendo is bricking systems that are trying pirated games on them. Is PlayStation or Xbox different?

    Fuck yeah- if I pay that much for a console they have no right to essentially destroy it at any time. Kind of barking up the same tree as Stop Killing Games here, but this goes against 2000 of years of commerce and business standards that exist for a reason!

  27. I hope they get reemed and this stops being a thing companies can do. Any company that bricks a console should be liable for the cost of the console and any legal costs used in recovery. Screw them and every other console company that thinks they have the right to destroy someone else’s property.

    So I read a few articles on this and apparently the Brazilian agency’s main concern is that Nintendo can brick the console **without explanation or notice.** It would seem that if Nintendo altered the EULA to provide notice before a ban occurs that it would be permissible. Nintendo says it will respond in 20 days though so we shall see.

    I think brazil is right, companies should not have the qbility to brick your device at will. And the fact anyone is trying to defend this is insane. Some argue “well nintenod hasnt done it, so whats the harm?”. Its like saying i put a small bomb in your car that will destroy your engine but i havent blown it up yet so what’s the harm?

    It’s a Fine line…I get people like to Mod and emulate but don’t be silly enough to go online with your modded version…They warned you they will do it so why in the hell would you chance it? If you’re dumb enough to try them, you’re dumb enough to have a bricked system. 😂🤷🏽‍♂️

    Legality of the TOS should be challenged, but you can’t realistically stop someone from being able to brick a system when they provide the software updates.

    Now, as for Brazilian law, that’s a matter for Brazilian lawyers.
