    The Polygon headline has it backwards. The EULA **mandates** arbitration. Essentially you agree that you cannot sue them or be part of a class action suit and instead must resolve it through an arbitration process. In theory this is a lower cost way to resolve a dispute. In practice the process heavily favors the corporation because they’re the ones who hire the arbitrator.

    Whoever wrote this title needs a lesson in English. It’s not an anti-arbitration clause, just a regular arbitration clause. Anti-arbitration would mean no arbitration.

    Strange article title since this is just an arbitration clause (not “anti-”). And these days, it’s basically a market standard one. This might be generally anti-consumer, but it isn’t anything wild.

    While not a good look, EULAs are not legally binding. You can just say you didn’t read it and it doesn’t apply.

    Trash company, haven’t played a game or bought a console from them in a few years. I’d rather play them on an emulator, usually with better frames.

    Between their inability to no be hyper protective over their IPs (that sit idle for 10+ years), making up patents that should never have been approved to sue a smaller company and the crap ton of shitty hardware issues with their consoles recently.

    Hope they get burnt soon.

    This is kinda standard, also not much seems to change? The EULA already had arbitration details in it. This is way more clear and adds way more details, but doesn’t seem to fundamentally change anything in claims. And also the title is wrong, lol, but it’s Polygon so nothing too unexpected.

  17. they are doing alot to dare users to op out of the ecosystem, players can vote with their wallets if they dont have a switch 2 yet, but i’m not optimistic.

    weakest spec they could have possbly offered, game cards, bricking, and now this.

    i’m still convinced that the only reason they have no oled version on launch is so buyers will double dip.

    Eh. I wasn’t going to buy a switch 2 anyway. I’ll stick to my playstation 3 and my extensive collection of physical discs. I miss the days when I pay 60 dollars and I’m done paying for it. The turning point was cakl of duty black ops 3. I mean it was 90 dollars for the base game and there wasn’t enough tar and feathering back then.

    Stop buying Nintendo products. All of these games that will be on this console are cheaper on all other consoles. If you want a handheld Steam Deck, ROG Ally etc and the games are even cheaper on sale!

    They are anti consumer every turn they take.

    Like when Disney tried to stop the lawsuit of the widow whose wife was killed in a Disney Restaurant because he signed up for a free trial of Disney+ once.

    Arbitration clauses rarely hold up along with most bullshit ToS agreements. It’s unreasonable to require people to waive their rights to use something they’ve purchased.
