As much as people hate EU regulations, the consumer protection laws are AMAZING!
Basically if a game is broken or differs/changes from advertised then under EU law, you have the right from the seller to be provided a fix/full or partial refund/replacement.
ANAL but this should apply to games as well as refunds of games. Terms of Service cannot break law, if a game is advertised as some and is sold under the pretense of some info, the ToS cannot change the law and accepting it does not give out your rights to get a refund when the product changes from what you bought.

Australia and EU both have great Consumer Protection Agencies. ACCC (Australian one) pretty much forced Valves hand to have a proper refund policy and fined them a very hefty sum for not following the countries refund policy laws, that is the reason why Steam has such a great refund policy.
There is much wrong with the world but by God the EU and Australia stands by their customers when they can.
Indeed, you can write what you want in your shitty TOS as well, that doesn’t stand above the law.
