PEORIA, Ill. – The city of Peoria is looking to dismiss its lawsuit against Boyd Gaming regarding the proposed Par-A-Dice casino redevelopment plans.
A Motion to Voluntarily Dismiss the case was filed on Friday.
The move comes after Boyd changed its plans earlier this month for a new casino to be built on a barge, instead of a land-based facility with a water basin running under it. The city of Peoria filed a lawsuit against Boyd, saying the move violates a 1991 intergovernmental agreement which states a land-based casino would be placed in Peoria.
A status hearing on the lawsuit was to take place this week. The original lawsuit was filed on February 3rd, two days before a planned vote by the Illinois Gaming Board on the new plans.
The IGB tabled the vote to February 26th after the barge idea was presented to the board.
In a statement, the city of Peoria says the lawsuit will be reinstated if Boyd reverts back to the land-based casino plans.
